This page is dedicated to supporting the public’s efforts to require the removal of fences recently constructed by a property owner to block the popular hiking trail on the Ontario Ridge between Avila Beach and Shell Beach. This trail, also known as the Shell Beach Ridge Trail, the Avila Ridge Trail, and the Upper Bluff Trail, has been used by the public for decades. By our open and continuous use
of this private land for over 5 years, the public has acquired a prescriptive easement over this trail. The er****on of fences to block us is a violation of these rights. Fortunately, the under the California Coastal Act, the California Coastal Commission is required to investigate and facilitate the enforcement of the public’s prescriptive rights to trails in the Coastal Zone. Where the public use of a trail or area is substantial enough to create potential prescriptive rights, the Attorney General’s Office has the authority to proceed with the legal action necessary to protect these use areas. Here are 4 things we can do in support of the effort to remove the fences on the trail:
1) Download, fill out, and mail to the Coastal Commission this Declaration of Public Use: http://www.coastal.ca.gov/access/OntarioRidge_PrescriptiveRights.pdf
2) Attend the Coastal Commission meeting at the Cliff’s Resort on Thursday, February 13 at 8:30 AM and speak or show support for speakers urging the Coastal Commission to help us remove the fences. The Coastal Commission holds an open public comment session starting at 8:30 AM.
