Opportunity for Formal Public Comment
Blue Mackerel is pleased to advise that we have referred our offshore wind project for decisions on the assessment processes required under both the Commonwealth Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) and the Victorian Environment Effects Act 1978 (EE Act).
The referrals outline the project’s proposed activities and provide the Commonwealth and Victorian regulators with the information needed to determine what assessment and approvals approach they require.
This is an important step in the project’s regulatory approvals process and demonstrates our ongoing commitment to meeting Australia’s environmental assessment requirements.
Different referrals and feedback pathways
Two referrals are needed because different parts of the project are located in different areas (jurisdictions) and to ensure both national and state environmental assets are considered under Commonwealth and State laws.
1. EPBC Act (Commonwealth)
The offshore licence area, where the wind project would be constructed, is located in Commonwealth waters and is therefore assessed under Commonwealth law. Matters of national environmental significance in the Victorian waters and onshore areas are also covered by this Act.
How to have your say
The EPBC Act referral documents (EPBC number 2025/10409) are published for public comment on the Department of Climate Change, Energy, Environment and Water's (DCCEEW) EPBC Act Public Portal.

2. EE Act (Victoria)
Two buried export electricity cables will run from the wind farm in Commonwealth waters through state waters to a connection hub in Giffard.
