*CLARIFICATION OF MISLEADING NEWS OF IMPRISONMENT ON ADULTERY ARTICLE OF THE NEW CRIMINAL CODE*

*"The article on adultery in the new Criminal Code that will take effect 3 years later is the Absolute Complaint Offense. This means that only husband or wife (for those who are married) or parents or children (for those who are not married) can make complaints. Other parties cannot report it, or even “playing judge” So there will be no legal process without complaints from the rightful party, who is directly harmed.”*

We need to provide this clarification following the rise in misleading and fundamentally erroneous news regarding the article on adultery which is considered to have a negative impact in the tourism and investment sector in Indonesia.

In fact, there are no substantive changes related to this article when compared to Article 284 of the old Criminal Code. The difference lies only in the addition of parties who have the right to complain and even if proven true, there are alternative sanctions of no more than 10 million Rupiah.

"So there's really nothing to worry about. If all this time tourists and investors can be comfortable in Indonesia, then this condition will not change either.”

It is proper for Indonesia to pay respect to Indonesian marital values through this article, as long as this regulation does not violate the private space of the public, including visiting tourists and investors.

In addition to the offense of complaint, the Criminal Code has never required the party entitled to complain to use that right (Because a complaint cannot be separated, meaning that it is impossible for a complaint to only one of the perpetrators to be processed, the decision to make a complaint will also be correct and really considered by those who have the right to complain.The new Criminal Code has also never provided additional administrative requirements for business actors in the tourism sector to ask anyone about their marital status.

Investors and foreign tourists don't have to worry about investing and traveling in Indonesia, because people's privacy is still guaranteed by law, of course without reducing respect for Indonesian values, so please come and invest in remarkable Indonesia!

Tidak bisa pihak lain melapor, apalagi sampai main hakim sendiri. Jadi tidak akan ada proses hukum tanpa pengaduan dari pihak yang berhak dan dirugikan secara langsung.”*

Klarifikasi ini perlu kami berikan menyusul maraknya pemberitaan yang menyesatkan dan keliru secara fundamental terkait pasal perzinaan yang dinilai membawa dampak negatif
pada sektor pariwisata dan investasi di Indonesia.

Sebenarnya tidak ada perubahan substantif terkait pasal ini jika dibandingkan Pasal 284 KUHP lama. Perbedaannya hanya terletak pada penambahan pihak yang berhak mengadu dan kalaupun akhirnya terbukti terdapat alternatif sanksi denda yang tidak lebih dari 10 juta Rupiah.

“Jadi sebenarnya tidak ada yang perlu dikhawatirkan. Kalau selama ini turis dan investor bisa nyaman berada di Indonesia, maka kondisi ini juga tidak akan berubah.”

Wajar saja jika Indonesia hendak memberikan penghormatan kepada nilai-nilai perkawinan Indonesia melalui pasal ini, sepanjang pengaturan tersebut juga tidak melanggar ruang privat masyarakat termasuk turis dan investor yang datang.

Selain deliknya aduan absolut, KUHP tidak mewajibkan pihak yang berhak mengadu untuk mempergunakan haknya itu (Karena suatu pengaduan juga tidak dapat dipilah-pilah, artinya tidak mungkin dalam pengaduan hanya salah satu pelaku saja yang diproses, maka keputusan membuat pengaduan itu juga pasti akan betul-betul dipertimbangkan oleh mereka yang berhak mengadu). KUHP baru juga tidak pernah memberikan syarat administrasi tambahan kepada pelaku usaha di bidang pariwisata untuk menanyakan status perkawinan siapapun.

Dengan demikian, para investor dan wisatawan asing tidak perlu khawatir untuk berinvestasi dan berwisata di Indonesia, karena ruang privat masyarakat tetap dijamin oleh undang-undang, tentunya tanpa mengurangi penghormatan terhadap nilai-nilai keindonesiaan, so please come and invest in remarkable Indonesia!

Latest Travel Regulations to Enter Bali as of 18 May 2022

You know what time it is? Yes, ! The President of Indonesia, Joko Widodo, imposed new regulations for those who are planning to travel to Bali. Since 14 October 2021, Bali has been gradually opening its doors to international tourists. On 3 February 2022, the inaugural commercial flight of Garuda Indonesia Airline carrying international tourists landed in Bali from Narita, Japan. By relaxing the travel restrictions to Bali, the Indonesian Government hopes that this move will be able to revitalize the country’s tourism.

On 7 March 2022, the government also applied a quarantine-free trial period and a Visa On Arrival (VOA) program for 23 selected countries. The list of countries was then extended to 42 on 22 March 2022, 43 countries on 6 April 2022, and then to 60 countries on 28 April 2022. Another great news to be noted is that from 18 May 2022, no RT-PCR test results are required to be taken prior to departure from the country or region of origin. To support the process of Bali reopening, the Indonesian Government will ensure to keep their utmost efforts to prevent the spread of COVID-19, namely by maintaining the status as one of countries with the highest vaccination rates, as well as the country that consistently provides safety protocols for all visitors. As of 6 April 2022, Bali is one of the top 3 provinces with highest vaccination rates and also one of the highest numbers of CHSE certifications.

1. Pre-departure Preparation
Before departing to Bali, you need to prepare yourself with the information about the Visa and requirements to enter Indonesia.

Entering with Visa on Arrival and Visa Exemption Facility

According to the Circular Letter of the Directorate General of Immigration No. IMI-0584.GR.01.01 of 2022 concerning the Ease of Immigration to Support Sustainable Tourism during the COVID-19 Pandemic effective from 28 April 2022, below are the list of countries and special entities for Visa On Arrival ( VOA ), in alphabetical order:

More details about the rules and regulations for VOA and Visa Exemption Facilities can be read on this link and can be summarized as follows according to the circular note from The Ministry of Foreign Affairs of the Republic of Indonesia No. SE/00035/PK/04/2022/64:

1. Visit Visa Exemption or Visa on Arrival for Leisure Purpose can be issued accordingly with the following requirements:
1. Passport (diplomatic/official/ordinary) that is valid for a minimum of 6 (six) months,
2. A return ticket or a pass to continue the trip to another country,
3. Proof of payment of PNBP Visa on Arrival of 500,000 IDR (in the case of applying for a
Visa on Arrival for Leisure Purpose), and
4. Proof of ownership of health insurance which includes financing for handling COVID-19 and medical evacuation to a referral hospital.

2. The entry stamp on the granting of a Visit Visa Exemption or Visa on Arrival for Leisure Purpose will be valid as a Visit Stay Permit with the certain period, as follows:
1. Visit Visa Exemption: maximum 30 days and cannot be extended.
2. Visa on Arrival: maximum of 30 days and can be extended once for another 30 days at the Immigration Office in the area where the foreign national lives.

3. Visit Visa Exemption or Visa on Arrival for Leisure Purpose can also be granted for foreign nationals on official visit or government duties to attend international events, for which shall be applied additional requirement: to enclose an invitation letter issued by the Indonesian government to attend the international conferences/trials/meetings.
4. The provision of Visit Visa Exemption or Visa on Arrival for Leisure Purpose as stipulated above applies to holders of diplomatic passports, service passports, or ordinary/general passports.

Entering with E-visa
According to the Circular Letter of the COVID-19 Task Force Number 19 of 2022 concerning Health Protocol for International Travel during the COVID-19 Pandemic, international travelers can also enter through I Gusti Ngurah Rai International Airport and Tanjung Benoa Seaport, Bali. Travelers who are not listed among the above mentioned countries can travel to Bali by applying e-visa before departure.

2. Arrival protocols
When you have arrived in Bali, there are several measures you need to take before you can continue your trip. According to the Circular Letter of the COVID-19 Task Force Number 19 of 2022 concerning Health Protocol for International Travel during the COVID-19 Pandemic, as of 18 May 2022, all international travelers, whether they are Indonesian citizens or foreign nationals, should comply with all the detailed regulations on this link.

The protocols can be summarized as follows according to the circular note from The Ministry of Foreign Affairs of the Republic of Indonesia No. SE/00035/PK/04/2022/64 :

1. All foreign travelers (foreign nationals) who will enter the territory of the Republic of Indonesia shall adjust their travel documents to ensure compliance with the provisions regarding the foreign travelers allowed to enter the territory of Indonesia, which includes Covid-19 vaccination certificates, RT-PCR examination provisions, quarantine period, and the use of PeduliLindungi application.

2. Foreign travelers must show a card/certificate (physical or digital) proving that you have received the second dose of COVID-19 vaccine, minimum 14 days before departure.

3. Upon arrival at the entry points, foreign travelers must undergo a COVID-19 symptom check, including a body temperature check, with the following conditions :
1. If there is no symptom of COVID-19 and body temperature is below 37.5 degrees Celsius: no need to undergo RT-PCR examination upon arrival
2. If there is any symptom of COVID-19 or body temperature above 37.5 degrees Celsius: must undergo RT-PCR examination upon arrival.

4. The provision regarding the period of isolation (quarantine) applies for all foreign travelers with the following categories:
a. Quarantine is no longer required for those who have received the complete dose of vaccine at least 14 days before the departure time.
b. Quarantine period of 5 x 24 hours is required for those who have not been vaccinated or have not received the complete dose of vaccine.
c. Foreign travelers under the age of 18 (eighteen) years and/or require special protection can follow the quarantine period provisions imposed on their parents or caregivers.
d. Foreign travelers who have not received a full dose of vaccination and completed isolation or treatment for COVID-19, as well as having been declared inactive in transmitting COVID-19, are allowed to continue the journey by attaching a doctor's certificate from the Government Hospital of the country of departure or the ministry that carries out government affairs in the health sector in the country of departure stating that the person concerned is no longer actively transmitting COVID-19 or the COVID-19 recovery certificate;
e. Foreign travelers with special health conditions or comorbidities that cause travelers to have not and/or unable to receive the COVID-19 vaccination, are allowed to continue the journey by attaching a doctor's certificate from the Government Hospital from the country of departure, stating that the person concerned has not and/or is unable to take part in the COVID-19 vaccination.

5. Health protocols must meet these requirements:
1. Wearing 3 ply of fabric mask or medical grade mask, covering nose, mouth, and chin at indoor settings or any crowded situations;
2. Replacing the mask regularly within every 4 hours, and dispose the waste in the proper place;
3. Washing hands regularly with water and soap or hand sanitizers;
4. Maintaining social distance for a minimum of 1.5 meters and avoiding crowds; and
5. It is strongly advised to avoid one and two ways communication through telephone or any direct conversation during travel using public transportation via land, train, sea, river, lake, crossings, and air.

6. The above policies are temporary and will be readjusted according to global health developments.

d. Other countries not mentioned above like India and etc still required Business Visa B211 to enter Bali and quarantine policy (subject to change )

e. Health requirements for foreign travelers enter Bali are:
1) proof of having completed a full COVID19 vaccination/booster;
2) negative result of PCR Swab Test administered before departure;
3) proof of a fully paid hotel booking or packages tours for a minimum of 4 days in Bali;
4)undergo PCR Swab Test upon arrival own expenses with available package cost approx. USD.120 per person (including twice PCR Swab Test ; 1st day and 3rd day as well as Indonesian Covid19 Insurance) ;
5) if the Test result is negative, the foreign travelers are permitted to continue visiting all tourism destinations around Bali;
6) if the Test result is positive, the foreign travelers are required to isolate in the appointed hotels with own expenses;
7) elderly foreign travelers with positive Test results and suffering from comorbidities are treated directly at the hospitals with own expenses; and
8) on the third day, foreign travelers are required to undergo PCR Swab Test, and if the result is negative, on the fourth day they are permitted to travel outside Bali.
f. Foreign travelers are still required to have health insurance that provides coverage for COVID-19 with minimum cover USD.25.000 (twenty five thousands USD) per person.
