In the night from 29th to 30th of May, around 1:30 AM, Edengarden Ayurvedic Resort in Varkala has been encroached by the former land owner Bhargavan Nair, wife Sobha Nair and their two sons named Ambu who himself is a lawyer and Vinod with the help of criminals. They threatened and locked our staff Mr. Kunjumon who stayed in Edengarden on this night since our permanent security was on leave. Luckily or unluckily myself Abhiram V.S, my life partner Michaela and our 1 year old son stayed in our leased staff quarters on that same night. Early morning we got the information about the event from Mr. Kunjumon, who managed to escape. We immediately went there. They stopped us forcefully from entering Eden. And immediately thereafter I contacted the tourism police and requested their assistance. One of the officers came to Eden to investigate what had happen. After seeing what they were doing, he advised me to go immediately to the police station.
Apparently, they rented out the land to a Third party who gave the resort the name “Ojus - Ayurveda & Yoga”
>>they claim the resort Eden Garden is not running since many years and that no things were taken, this place was always theirs and they are simply doing maintenance for their resort.
People that have been in Eden Garden and are close to my family know, that we have been living there since 1997 and are running this institution continuously without gaps.
We have more then enough evidence stating our existence and activity as a resort and our home.
Of course, that same Saturday we went straight to the main local police officer called Circle Inspector (C.I) to file a case against those people. The C.I, who is a friend of above mentioned Ambu stated, he couldn’t help us, since there was an Injunction order against me, stopping us from entering the property. This turned out to be fake: we received an application for this order on Monday and the Order was effectively issued on Tuesday only. Cleary, this officer misled us and made us lose valuable time !
Since the crime happened on the weekend we couldn’t approach the court. So instead, on Sunday we went to Trivandrum to see our lawyer. He told us to contact the Minister of Tourism, the Chief Minister of Kerala and other significant regional authorities to get support and in the meanwhile we should also spread the word about this injustice that is being tolerated by the local authorities through all possible Media Channels - so that our voice will be heard !
On Tuesday, finally(!!) we were able to get inside of the property together with a police officer to take a statement of the current situation. We looked in all the rooms and buildings. They emptied out all the rooms and looted everything of value (documents, seals, vouchers, guest files, money, gold, electronic devices, tools, room amenities, kitchen utensils, gas cylinders, various furnitures, sheets, mattresses, antiques, washing machine, induction cookers ... ). The CCTV and surveillance system were uninstalled and destroyed, what leads us to not having any evidence against the crime.
Yesterday, Thursday, we went to see the DGP (Director General of Police of Kerala), we were not even allowed to enter the compound of the police head quarters. Due to Covid19 they are not letting anybody inside.
A few days back we were celebrating my son Adityas’ birthday with our friends and family making wonderful memories in Eden, our home.
Today, 2 weeks later we are treated like intruders in our own home. From the outside we have to watch these people sitting on our chairs, drinking from our glasses, using and polluting our space.
Imagine, in the middle of the night you are thrown out of your own house, the people that encroached you take out all of your belongings and claim, you never lived there, the house is not yours and they don’t know where all of your things are. You cannot prove you are in the right, because all the evidence was taken. No authority is willing to help you. What would you do ?
Instead of striking back violently, we decided to get righteousness through legal procedures. This turns out to be very hard due to a corruptive system that backs the mafia and also due to the current Covid-19 Crisis, which shifts the authorities focus - leaving such crimes unseen.
I am asking you, if you find to read truth in our words: make some noise with us!
We are currently addressing many state authorities, like the Chief Minister of Kerala, Tourism Ministers of Kerala and India, various high ranking police officers…
