Vallarta property buyers face Profeco contract warnings

PUERTO VALLARTA, Jalisco, Oct. 2, 2026 — The federal consumer protection agency Profeco has intervened in at least 20 real estate businesses in Puerto Vallarta and Bahía de Banderas, according to information from its regional office published Friday.

The local office reported complaints involving altered contracts, misleading advertising and delayed housing deliveries. Buyers also reported missing documents and homes built with materials different from those specified in their agreements.

Inspectors placed precautionary notices at a Marina Vallarta development and a business in Mezcales, according to the same account. The businesses have deadlines to address the agency’s findings.

Delivery dates and contract protections
For this report, we reviewed Mexico’s housing sales standard, NOM-247-SE-2021. It requires purchase contracts to state the delivery date and conditions.

The rule covers developers, builders, promoters, and other businesses that advise on or sell housing to the public.

Under Section 6, delivery delays can trigger contractual penalties or claims for damages. When causes beyond the seller’s control justify non-delivery, the parties can agree on a new date.

The standard also requires contractual penalties to be reciprocal and equivalent for the buyer and seller.

Under the standard, housing purchase contracts must be in Spanish. The Spanish text prevails when versions differ.

Inspectors compare signed agreements
Profeco’s local office said inspectors compare the registered contract model with the latest agreement a customer signed. The review checks whether the business changed the clauses.

Section 6 states that differences from the registered contract that harm consumers are treated as though they were not included.

In a case reported Sept. 12, Profeco suspended sales by Consultoría Inmobiliaria CIN S.A. de C.V. Inspectors visited its office at 3660 Boulevard Francisco Medina Ascencio in Villas Las Flores.

The agency said the company did not provide signed customer contracts or transaction receipts requested during the inspection. Inspectors could not verify whether the registered model was being used or whether customers received receipts.

We also reported a sales suspension at Soleva on Sept. 12.

“It is one of the sectors that generates the most complaints,” regional office director Myrna Encinas said in Spanish in remarks published Feb. 9. She urged buyers to request contracts registered with Profeco.

Public records buyers can consult
Profeco’s public contract registry lets buyers search by the provider’s legal name, trading name or registration number. The results provide access to registered contract models.

The agency’s commercial complaint database contains public information through Aug. 31, 2026. Profeco cautions that it excludes complaints still being processed and therefore does not show every complaint received.

Under Section 6 of the housing standard, sellers must give buyers an original signed contract, including its annexes.
