Málaga Freezes New Tourist Apartment Permits for Three Years!

The city of Málaga has announced a three-year freeze on new permits for tourist apartments. The measure will take effect once it is published in the Provincial Official Gazette, though it could end earlier if a new zoning plan is completed.

This decision comes as the rapid growth of vacation rentals has increasingly put pressure on the housing market. More and more residential homes have been converted into short-term tourist apartments, reducing availability for locals. Earlier measures – such as stricter access rules and restrictions in neighborhoods with a high density of tourist flats – were not enough to curb the trend.

Currently, Málaga has nearly 12,800 registered tourist apartments, of which about 8,600 are actively rented. In 53 neighborhoods, the share of tourist apartments already exceeds 8% of the total housing stock.

The freeze will allow the city to update its outdated 2011 urban plan to better reflect today’s reality. The goal: strike a balance between the city’s vital tourism industry and the rights of residents to affordable housing.

Mayor Francisco de la Torre emphasized that tourism will always be essential for Málaga’s economy, but stressed that “the right to live in the city is just as important.” Over the next three years, the municipality will work with residents, the tourism sector, and experts to develop new rules that protect both the city and its housing market.
