Permits: For further clarification on the boards position on permitting here is a summary. Please keep in mind the Board has a fiduciary obligation to follow the SFOA governing documents, and rules when issuing permits.

When a member applies for a permit, the member fills out the permit along with a grid paper documenting what actual measurements of the structure to be placed on the lot are. Included with the measurements the drawing needs to show how the structure sits on the lot in regards to lot lines and setbacks. In addition, all four corners of the lot need to be flagged, once that is done and the lot is compliant the environmental committee will issue a permit. Once the project is completed the Environmental committee inspects the lot to be sure the structure was completed as presented per the permit. In the event the project was actually done differently then presented the permit closure is denied and the structures will need to be moved to match the original description. (Pretty simple)

Now let’s say you apply for a new permit and it is determined by the environmental committee that old structures are sitting in the setbacks and or common grounds the board has taken the stance that we cannot turn a blind eye to that like some past boards have done. So again, very simple bring your lot into compliance or you do not get a permit for your new structure. We are handling this one lot at a time as has been explained many times. The board has no authority to allow a member’s structures to remain on common ground. The board does have the authority to give temporary permission to allow setback violations and we now have a document to allow some setback violations to take place. Note: Setback violations temporary permission will only be considered on existing structures when applying for a new permit for a new structure. Not all setback violations will be given temporary permission this will be considered one lot at a time and must be approved by the environmental committee and the board of directors.

Subject: Clarification and to Address Rumors Running Within the Forest.

Dear Association Members,

The Board of Directors is issuing this communication to clarify recent enforcement actions regarding common ground property lines. Our goal is to ensure all members have accurate information and to reinforce our commitment to fair rule enforcement.
Recently, questions have arisen regarding a specific enforcement action, with concerns raised that an individual lot owner is being unfairly targeted. We want to assure the community that this is not the case. The Board acts strictly based on official documentation, rules and community governing documents.
In this specific instance, a standard review revealed that structures were built on designated common ground. A cross-reference with the original, SFOA approved permit application showed that the structures were not placed in the locations that had been officially approved. The permit application submitted by the member contained lot layout representations, but the actual physical construction did not match those approved plans.
Because the placement of these structures directly violates the approved permit and encroaches onto shared community property, the Board must take action. We are simply requiring that the member adjust and move the structures to match the exact specifications detailed in their own approved permit application.
The Board has a legal and fiduciary duty to protect community property and ensure that all architectural guidelines are followed consistently. We do not target individual members; we enforce the agreed-upon rules and the permits issued under them to protect the property values and rights of the entire community.

Just a reminder once our Treasurer finalizes the April financials and we have the meeting agenda completed along with the packet we will send out to the membership prior to the May 16th meeting. New " Minnesota HOA Bill of Rights" (HF 1268/SF 3432)

Members regarding the above bill approved by Minnesota legislators but not yet a law until it is signed by the governor.
We see a lot of speculation and mis information on Facebook and wanted to update the members in regards to this issue.
In the event this becomes law for the most part this new law will not affect SFOA in most parts of the law the vast majority of what is in the new legislation will not impact SFOA. There are some new obligations regarding resale disclosure certificates under 515B.4-107 which will apply to any CIC (including SFOA) and new language about the ability to terminate a CIC. However, the revisions regarding fines, late fees and collections, are not applicable.
Why are the revisions regarding fines, late fees and collections not applicable to SFOA?
Although SFOA is an association community, it is not governed by the Minnesota Common Interest Ownership Act because it is a planned community built prior to June 1, 1994 where the association has no obligation to maintain any building on any lots.
The board will keep the membership updated as we learn that this has become law. Until this becomes law and the SFOA attorney knows exactly what the signed law states it’s business as usual. Even if something changes and all the sudden provisions were inserted into the new law, that would apply to any CIC including SFOA, we will keep you updated. Regardless if this does become law it will not take affect until January 1st, 2027.
