I have been back in Indiana for a week now and am already looking for cheap airline tickets to return to Englewood. It is a helpless feeling to be 1200 miles away with so much to be done to the resort.
I have been reminded that we have several owners that have only recently joined our page so it is time for an update, so here goes.
Hurricane Ian caused the resort to close on September 28, 2022. Resort staff did an amazing job of bringing buildings 2 and 3 back on line by the week of Christmas. Most of their repairs were temporary with a focus on safety and making the structures weatherproof. Unfortunately building 1, along with the pool and spa will be closed indefinitely.
The resort was insured by Lloyd’s of London for $3,409,346 with a deductible of 10% ($340,935). The preliminary replacement cost estimate totals to $1,935,600. Because the damage to building 1 exceeds 50% of its appraised value, repairs to it must meet current building codes. The damage estimate does not include the extra cost of current code compliance. So does that mean building 1 must be totally demolished or just needing a major renovation? That is to be determined. There would be a significant difference in cost if a total rebuild is necessary.
We have approached a local architect with significant experience working on Manasota Key for his advice. To determine whether the existing building 1 structure can be made to meet the current minimum elevation for the lowest occupied floor, a certified site survey is required. The estimated cost for the survey is $3,500. If the survey does not prove the first floor elevation meets the current code, demolition of the whole building will be required. We are on a 6 week waiting list for the survey.
Meanwhile, the insurance company has issued an advance of $350,000 to reimburse for repairs and loss of business income. The balance of the claim is temporarily on hold. Building 2 repairs will commence once a complete scope of work has been detailed and contractors have provided bids for the Board’s approval. The same applies to building 3.
Because the south Florida devastation was so wide spread, there are few contractors available for roofing, soffit, facia, guttering, windows or lanai framing and screening. Add to that the scarcity of materials and labor and inflation in general which explains why everything is taking longer and costing more.
Now the questions most owners are asking: when will it be done and how much will it cost us? My guess is longer than you think and more expensive than you want. Others have asked about just selling the whole resort or what about tearing down building 1 and operating the resort with only 11 rooms, or selling off the building 1 lot. Can we add an elevator to building 1? You may have other questions so feel free to ask.
Cunningham Property Management and your board of directors are working to gather the information needed to present a recommendation for your vote. As much as I would love to tell you when that might happen, I don’t know. My goal is as soon as possible. Our next board meeting is planned for Monday April 3 at 10:00 am.

Well today is the due date for our 2023 maintenance fees of $645 for each week owned. I know many of you are reluctant to commit to ownership of your weeks, especially owners of building 1. As a building 1 owner myself (I own 15 weeks in building 1 and 1 week in building 2) believe me, I do understand. It was difficult for me to write the check without a place to stay this winter. But being the ever optimist, I see 2 positive outcomes probable. I believe we will either raise enough money through fees and special assessments to rebuild building 1 OR the owners will vote to sell the resort in which case we will all realize a profit from the rising land values and scarce beach front property.
Kevin Mattoni and your board are working hard to gather enough information so that we can ask all owners in good standing for their decision. Please show your loyalty to EBYC and continue to have a say in the future of the resort. Please pay your maintenance fees.

To All Englewood Beach and Yacht Club Owners,

Management will be regularly providing updates on the resort operations through email blasts, resort website, www.englewoodbeachresorts.com under owner's tab, and the owner page that is overseen by the new Board president, Joe Mikesell. Management's goal is to communicate with owners as quickly as possible as we wade through the issues caused by Hurricane Ian.

ANNUAL MEETING

The annual meeting was held at the property on the lawn east of phase 1 and 3 bay side. The largest owner turnout that anyone can remember filled well over 50 chairs. Needless to say, owners attended were looking for answers.

The annual meeting agenda included the election of new board of directors.
Your new Board of Directors are;

V. President- Nancy Stayrook
Secretary- Sam Cohen
Treasurer- Jerry Laskowski
Director- Dean Harloff

Also, on the agenda was approving the 2023 maintenance fee budget. The budget was approved. The billing was sent out to all owners. This money is needed immediately. All owners, including those in building 1, must pay their 2023 maintenance fees when due.
At the meeting, the management company's owner, Eddie Webb, informed owners of his retirement after over three decades of service to EBYC. He introduced Cunningham Property Management Corp representatives Richard Cunningham and Kevin Mattoni. Cunningham is based in Sarasota and specializes in the management of Legacy timeshare resorts in Florida.

GORILLA AT THE MEETING

The needless to say reason for the in-person attendance of such a large number of owners is "what are we going to do now"?
Phase 1 building, consisting of ten 1-bedroom units, is completely closed from the storm damage along with the swimming pool, whirlpool, and docks.
Our insurance carrier sent out an independent inspector who also retained engineers to assess the damage. An extensive detailed report was provided to management.
The direction the resort decides to take will determine the total payout from insurance. Several factors come into play that need to be reviewed.
The insurance company has delivered an initial payment of $350,000.

What options are available?

Can the one bedroom units realistically be repaired? NO due to extensive damage and new building code requirements.

Can the damaged building be replaced? The Board and management are meeting with engineers and contractors to determine feasibility of rebuilding.

What happens to the affected owner's vacation time? Buildings 2 and 3 are available to be occupied or listed for rent. Exchange companies have the resort on hold and are not accepting exchange requests. Owners in building 1 will not receive any vacation time at the property in 2023.

Are affected owners in building 1 still responsible to pay 2023 maintenance fees if they do not receive vacation time? Yes, property has ongoing operating expenses that all owners are required to pay.

What is the future of EBYC? It is too early to speculate on what the future might be for the property. We have state statutes, local building requirements, and our condominium documents that must be reviewed and complied with. Once we understand what can and can't be done, management will lay out the options for owner consideration. The insurance proceeds will not be sufficient to rebuild building 1. Management expects special assessments to all owners will be necessary for ongoing operating expenses and if building 1 is to be rebuilt.

BOARD DECISIONS

The Board will be sending out an owner proxy to vote on 2 amendments to the condominium documents.
The first is an amendment that clearly states the association is governed by its recorded declaration and by-laws and by Florida state statutes as written and amended from time to time.
The second allows the Board of Directors to act as the insurance trustee for the association when receiving and disbursing money from the insurance carrier.

The Board also decided to give current owners the first opportunity to purchase association owned inventory through a silent auction that will be sent out by management. Most of the inventory is in building 1 and it cannot be used in 2023. Details will be in the auction information that will be provided to all owners. Buyers will receive a disclosure clearly stating these weeks will not have any occupancy rights in 2023, if ever. The disclosure will also state that all owners have an financial interest in the insurance claims and all owners have a financial interest including any special assessment to rebuild building 1 if that decision is made. The Board is taking this path as the association is in need of a cash infusion to continue operating.

OWNER COMMUNICATION

As this all progresses, management will make every attempt to keep owners informed. Decisions need to be made. Proxy votes need to be taken. Owners need to stay current with what is happening and stay involved. The most efficient way to accomplish this is through emails sent to owners plus updating the resort website and the page. Owners need to provide current email addresses to management.
Your Board of Directors and management cannot select the best path if we do not have owner participation.
Do not leave these decisions or responsibilities in other's hands.
Respond when asked, vote when needed.

This is only the first of what will be several updates over these next 4-6 months
