The Michigan Legislature is currently considering legislation that would regulate short-term rentals across the state. House Bill 5438 (“HB 5438”) would establish a state-run short-term rental registry and require short-term rental operators to register their properties with the Michigan Department of Licensing and Regulatory Affairs. This new requirement would apply even if a property is registered with a municipality pursuant to local law. HB 5438 would also establish a short-term rental excise tax and regulate short-term rental booking platforms.
Although HB 5438 was introduced in February, it has not yet been voted out of committee. Now, with only a few days of session left, the bill could be fast-tracked without further deliberation in committee. We encourage you to contact your legislators today and urge them not to rush this complex bill through the legislative process in the final days of session.
